These Terms of Service ("Terms") govern your use of the EasyPerformer mobile application, our website, and related products and services (together, the "Services"). By using the Services, you agree to these Terms. If you do not agree, please discontinue use of the Services.
EasyPerformer is a music performance tool developed and operated by EasyPerformer, based in the Netherlands. For any questions, you can reach us at info@easyperformer.com.
You may use the Services for personal, non-commercial purposes in accordance with these Terms. You agree not to misuse the Services, attempt to reverse engineer any part of the app, or use the Services in any way that violates applicable law. We reserve the right to suspend or terminate access to the Services if these Terms are violated.
Creating an account is optional. If you choose to register, you are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You can delete your account at any time via the in-app settings or by contacting us.
EasyPerformer offers paid features and content. Purchases made through the Apple App Store or Google Play Store are subject to the terms and refund policies of those platforms. Purchases made directly through our website are subject to our Refund Policy below. All prices are shown inclusive of applicable taxes where required by law.
All content, design, code, and materials within the Services are owned by or licensed to EasyPerformer and are protected by applicable intellectual property laws. You may not copy, distribute, or create derivative works from any part of the Services without our prior written consent. Content you import or create within the app remains yours; we do not claim ownership over it.
We strive to keep EasyPerformer as reliable, accurate, and error-free as possible, and we take the quality of the app seriously. That said, the Services are provided "as is" and "as available" without warranties of any kind, express or implied. We cannot fully guarantee that the Services will be uninterrupted, error-free, or suitable for any particular purpose. To the extent permitted by applicable law, we disclaim all warranties.
To the maximum extent permitted by Dutch and EU law, EasyPerformer shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services. Our total liability shall not exceed the amount you paid for the relevant purchase in the 12 months preceding the claim. Nothing in these Terms limits liability for fraud, gross negligence, or any other liability that cannot be excluded by law.
We may update these Terms from time to time to reflect changes in the app, our practices, or legal requirements. We will post the revised Terms on this page and update the "Last updated" date. For significant changes, we will notify you via an in-app notice. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Netherlands. If you are a consumer residing in the EU, you also benefit from any mandatory protective provisions of the law of your country of residence. Any disputes shall be subject to the jurisdiction of the competent courts in the Netherlands, without prejudice to your rights as a consumer under applicable EU law. If you are located outside the EU, local mandatory consumer protection laws in your country may also apply.
